and services (collectively, the "Service") provided by Cubby ("we," "us," or "our").
By creating an account or using the Service, you agree to these Terms. If you do not agree, strictly
do not use the Service.
1. Description of Service
Cubby is a daycare management platform designed to help childcare providers manage rosters,
attendance, staff, and communications.
2. Accounts and Registration
To use the Service, you must register for an account. You agree to provide accurate, current, and
complete information during the registration process.
- Security: You are responsible for maintaining the confidentiality of your login
credentials. You are responsible for all activities that occur under your account.
- Eligibility: You must be at least 18 years old to use the Service.
3. Subscriptions and Fees
- Trial: We offer a 14-day free trial. No credit card is required to start the
trial.
- Pricing: After the trial, the Service costs $49.95 per month
for the first center, and $24.95 per month for each additional center. Annual
billing is available at $499 per year for the first center.
- Billing: Fees are billed in advance on a recurring basis. You may cancel your
subscription at any time; however, no refunds are provided for partial months or years.
- Changes: We reserve the right to modify our pricing with reasonable notice to
you.
4. User Content and Data
- Ownership: You retain ownership of all data, information, and content ("User
Data") you upload to the Service, including staff and children's records.
- License: You grant us a worldwide, royalty-free license to use, host, store,
and display your User Data solely as necessary to provide the Service to you.
- Prohibited Content: You agree not to upload data that is illegal, harmful, or
violates the rights of others.
5. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose.
- Attempt to reverse engineer or hack the Service.
- Harass, abuse, or harm another person via the Service.
- Share your account credentials with unauthorized users.
6. Termination
We may suspend or terminate your access to the Service at any time if we believe you have violated
these Terms. You may delete your account at any time through the application settings.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT
WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES
OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CUBBY SHALL NOT BE
LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF
PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
9. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or through
the Service. Your continued use of the Service after such changes constitutes acceptance.
